By downloading, installing, or using the Infinite Perks mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.
2. Description of Service
Infinite Perks provides a platform that aggregates and displays deals, discounts, and offers from various third-party merchants, including dining, fuel, and activity providers. The App displays these deals on an interactive map and in list format for user convenience.
3. No Guarantee of Deals or Prices
While we strive to provide accurate and up-to-date information, we do not guarantee that:
- All deals displayed are currently active or available
- Fuel prices are accurate at the time of viewing
- Merchants will honour the deals shown in the App
- Deals have not expired or changed since being published
Deals and prices are sourced from third-party providers and may change without notice. Always verify the deal directly with the merchant before making a purchase.
4. Third-Party Merchants
The deals displayed in the App are provided by third-party merchants. Infinite Perks is not a party to any transaction between you and the merchant. We are not responsible for:
- The quality, safety, or legality of products or services offered
- The accuracy of merchant information
- Any disputes between you and a merchant
- Any loss or damage resulting from a merchant transaction
5. Location Data
The App uses your device’s location to display deals near you. Location data is processed on your device in real-time and is not stored or shared with third parties. See our Privacy Policy for more information.
6. User Conduct
You agree to use the App only for lawful purposes. You will not:
- Use the App to violate any laws or regulations
- Attempt to reverse engineer, decompile, or disassemble the App
- Use automated tools to scrape, harvest, or collect data from the App
- Interfere with the proper functioning of the App
- Share deals or content from the App in a way that violates merchant terms
7. Intellectual Property
The App, including its design, graphics, logos, and content, is the property of Infinite Perks and is protected by Australian and international intellectual property laws. Deals and merchant content remain the property of their respective owners.
8. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:
- The App will be uninterrupted or error-free
- The information is accurate, complete, or current
- Defects will be corrected
9. Limitation of Liability
To the maximum extent permitted by law, Infinite Perks shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the App, including but not limited to:
- Loss of profits, data, or business opportunities
- Inability to access or use the App
- Actions or omissions of third-party merchants
- Any transaction made through a third-party merchant
10. Indemnification
You agree to indemnify and hold Infinite Perks harmless from any claims, damages, losses, or expenses arising from your use of the App or your violation of these Terms.
11. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. The “Last Updated” date at the top of this page reflects the most recent revision.
12. Changes to the App
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.
13. Termination
You may stop using the App at any time by deleting it from your device. We may terminate or restrict your access to the App at any time, without notice, if we believe you have violated these Terms.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of New South Wales.
